Terms & Conditions

These terms govern your use of Netball Hero (the "Service"), a netball performance tracking application provided by J29117 ("we", "us"). By creating an account or continuing to use the Service you agree to these terms. If you are signing up on behalf of a club or organisation, you confirm you have authority to bind it; if you are signing up as an individual, you confirm you are of legal age to contract.

1. The Service

Netball Hero lets coaches, clubs and individuals record netball match statistics quarter by quarter, view totals, shooting accuracy, gains scores and player insights, and store match history against their account. Access is provided under a paid plan (Individual Pass, Club Pass or EMMNA Nationals). Club plans allow up to three user seats.

2. Your account

• You must provide accurate registration details and keep them up to date.
• You are responsible for keeping your password confidential and for all activity under your account. Accounts are limited to one active session at a time and must not be shared beyond the seats included in your plan.

3. Acceptable use

You must not misuse the Service. In particular, you must not:

• use it for any unlawful purpose, or to commit fraud or send spam;
• infringe anyone's intellectual property or privacy rights;
• interfere with the security or integrity of the Service, including introducing malware, probing or scanning for vulnerabilities, scraping, or circumventing technical limits such as seat counts or paywalls;
• reverse engineer, resell or redistribute the Service.

4. Licence and intellectual property

We grant you a limited, non-exclusive, non-transferable right to use the Service within your selected plan. J29117 retains all ownership of the Service and its intellectual property, including the software, design, branding and documentation. You keep ownership of the match data and player names you enter, and grant us a licence to host, process and analyse that content in order to provide and improve the Service (see clause 5 and our Privacy Notice).

5. Data processing and AI use

All data you enter into the Service is held on file by J29117 and may be used at J29117's discretion for artificial intelligence purposes, including analytics, model development and product improvement, unless you notify us otherwise. You may withdraw this use at any time by contacting us, and we will exclude your data from those purposes going forward. Do not enter personal data about third parties (including players) unless you have the right to do so.

6. Payments, billing and subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, renewal and cancellation mechanics are governed by Paddle's Buyer Terms. Subscriptions renew for the plan period selected at checkout unless cancelled beforehand.

7. Promotional prices

Where you purchase a subscription at a promotional or discounted price, no refund is due once the Service has been utilised. For these purposes, the Service is considered utilised as soon as you access or use any paid feature after the subscription begins.

8. Service level and warranties

We aim to keep the Service available but do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. Statistics and insights are provided for coaching purposes only.

9. Liability

To the fullest extent permitted by law, our aggregate liability is capped at the fees you paid in the twelve months before the claim, and we exclude liability for indirect, consequential or special damages, including loss of profits, data or goodwill. Nothing limits liability for fraud, death or personal injury caused by negligence, or anything else that cannot be limited by law.

10. Indemnity

You indemnify us against claims arising from the content you enter, your unlawful use of the Service, or your breach of these terms.

11. Suspension and termination

We may suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination your access ends; you may request an export of your match data within 30 days, after which it may be deleted or anonymised.

12. General

You may not assign these terms without our consent; we may assign them in connection with a merger or acquisition. Neither party is liable for delays caused by events beyond its reasonable control. These terms are governed by the laws of the United Arab Emirates, and the courts of Dubai have exclusive jurisdiction, without affecting any mandatory consumer rights in your country of residence.
